I contacted a mcafee labs tech and he said you need to contact support and open a job case. I would assume that you will get nowhere with the initail call and will have to request an escalation but I could be wrong.

Peacekeeper : LOL, that's exactly what I was thinking, but I'll take your advice and try to get it escalated. I will use the phrase "open a job case" over and over again. Any other key words that might be helpful?
I also reasked this of the tech as anytime you mention malware detection to them they try to sell you removal services and that is not what you want. Try asking them and if any problems escalate and post back here please

There is no detection alert being show. It could be a case of access protection or even a silent firewall/hips block.
This is more of a technical support troubleshooting issue than a false detection.
So pass that onto support
Well, I phoned in today and made it up to Tier2 Escalations, so I guess made some progress. Am waiting to hear back from them now.

Well, they ran some remote tests on my machine, got me to reproduce the error, uploaded some logs, and it seems they have acknowledged the problem and have told me they will fix it in the next release (12.9), which they said will be out in a month or two.
In the meantime, I would like to add detection code to my program so I can warn my users that they need to change settings. What's the best way to detect McAfee, especially version number? Is there a definitive .EXE I can check the version of, or a registry key I can query? If you would rather send this info to my privately, send me a PM.
